Terms and Conditions of Portal Usage

Statutory Operations Protocol Protocol Revision: October 2026

⚠️ Regulatory Enforcement Notice: By initializing an account profile, completing the onboarding wizard, or submitting documentation payloads to this portal, you explicitly bind your corporate organization to these statutory terms. If you disagree with any clause listed herein, you must immediately halt usage of the portal terminal.

1. Statutory Declarations & Eligibility

Usage of the National Electronic Labour Exchange (NELEX) Private Employment Agencies (PEA) Platform is restricted strictly to legally incorporated entities registered with the Corporate Affairs Commission (CAC) of Nigeria. The individual creating the profile asserts that they possess full executive legal authorization to act as a fiduciary agent on behalf of the registered corporate entity.

2. Accuracy of Data & Severe Anti-Forgery Prohibitions

Applicants bear sole criminal and civil liability for the absolute accuracy of all uploaded datasets. Under the applicable regulatory framework rules of the Federal Ministry of Labour and Employment:

  • Submission of falsified or altered documents (including forged CAC certificates, FIRS tax logs, or NSITF clearances) will trigger an **instant, irrevocable blacklisting** of the profile.
  • The system automatically records background metadata logs—including the **uploading user's name, timestamp, and IP address**—as a permanent, tamper-proof forensic audit trail matching your model rows.
  • Verified corporate forgery instances will be handed over directly to relevant law enforcement agencies for federal criminal prosecution.

3. Financial Settlement, Invoicing, & Non-Refundability

All financial transactions handled via the project's integrated **Remita Gateway API** are subject to strict treasury processing rules:

  • Application Deposit Fees (Step 2): Are completely non-refundable upon submission, regardless of whether the Ministry ultimately approves or rejects the profile's vetting state.
  • Dynamic License Issuance Fees (Step 4): Are automatically computed based on your corporate parameters (such as domestic or international placement scope multiplied by operational sector configurations).
  • Licenses will not be printed or released to the applicant certificate vault until the central billing registry records an absolute status change to **`PAID`** from the Remita API loop.

4. Background Security Vetting & File Sanitisations

To maintain the technical safety and processing integrity of public databases, every file uploaded to the checklist vault undergoes background automated processing:

  • Files are intercepted by **ClamAV heuristic daemons** to check for embedded malicious vectors or macro viruses.
  • Files are optimized using **Ghostscript binary trimmers** to compress resolutions into lightweight sizes while stripping hidden tracking metadata.
  • Files that trigger system virus signatures or fail mime structural matching rules will be rejected instantly by the upload controllers before hitting disk blocks.

5. Dynamic Workflow Desks & Delegation Rights

The Ministry reserves the right to globally delegate, route, re-assign, or query any pending folder at any stage in the onboarding lifecycle. The **Permanent Secretary** retains total architectural oversight to review files and overwrite pipeline milestones at any time to guarantee procedural transparency and clear administrative bottlenecks.

6. System Indemnification Clauses

The Federal Ministry of Labour and Employment shall not be held civilly liable for any corporate operational losses, business interruptions, or processing delays arising from upstream system maintenance windows, telecommunication carrier SMS bottlenecks (such as Twilio segment drops), or external federal lookup endpoint downtime (including CAC or banking gateway timeouts).
